Moment.Us, LLC — Terms and Conditions
Last updated: October 16, 2026
These Terms and Conditions ("Terms") govern your use of the website www.makeitmoment.us and the services provided by Moment.Us, LLC ("Moment.Us," "we," "us," or "our"), including photo booths, enclosed and open-air booths, Glambot and red carpet experiences, 360 video booths, AI booths, live portraits and portrait booths, trading card stations, video guestbooks, live event photo and video coverage, headshots, live engraving, personalized merchandise, drop-off booth rentals, branded and wrapped booths, and venue placements (together, the "Services"). By using our website, booking our Services, or opting in to our communications, you agree to these Terms. If you sign a separate proposal, contract, or service agreement with us, that agreement controls where it conflicts with these Terms.
1. Proposals, Booking, and Payment
Quotes and proposals are valid for the period stated on them. A booking is confirmed only after you sign the contract and pay the required retainer or deposit.
You agree to provide accurate event details, including date, times, venue, load-in and parking information, power access, and on-site contact.
Remaining balances are due on the schedule in your contract, and in all cases before the event unless otherwise agreed in writing.
Payments are processed through our payment processor (Stripe). Applicable sales tax is calculated based on the event or billing location as required by law.
Additional time requested on-site, added services, travel outside our standard service areas, venue fees, parking, and overtime are billed at the rates in your proposal or our current rates.
Contracts may be signed electronically, and electronic signatures are binding.
2. Cancellations, Rescheduling, and Refunds
Cancellations must be made in writing to hello@makeitmoment.us.
Retainers and deposits are non-refundable unless your contract states otherwise, because they reserve your date and equipment.
Rescheduling is subject to availability and the terms of your contract.
If we are unable to provide the Services due to circumstances within our control, our liability is limited to a refund of amounts paid for the affected Services.
Neither party is responsible for failure to perform due to events beyond reasonable control, such as severe weather, natural disaster, public health orders, venue closure, power or internet outages at the venue, or government action.
3. Event Requirements and Use of Equipment
You are responsible for providing a safe, level setup area with the space, power, and access described in your proposal, and for any venue approvals.
Guests must use the equipment responsibly and follow staff instructions. Our staff may pause or stop service if conditions become unsafe or equipment is at risk.
You are responsible for loss of or damage to equipment caused by you or your guests through misuse, negligence, or theft, other than normal wear.
Drop-off rentals and venue placements: For unattended or drop-off booths and long-term placements, the client or venue is responsible for supervising, securing, and protecting the equipment while it is in their care, and for any additional terms in the rental or placement agreement.
4. Designs, Branding, and Client Materials
You grant us a limited license to use logos, artwork, and brand materials you provide solely to create your templates, overlays, wraps, engravings, merchandise, and event assets. You confirm you have the rights to provide them.
Design proofs must be approved by the deadline in your contract. Changes after approval may incur additional fees.
Custom booth wraps, engraved items, and personalized merchandise are made to order and are non-refundable once production begins.
5. Event Content and License
Your use: The client, and guests who receive their content, may use event photos, videos, GIFs, and AI-generated images for personal and, for corporate clients, internal and promotional business purposes.
Our use: Moment.Us retains ownership of the underlying content and our template designs, and may use select event content in our portfolio, website, proposals, and social media unless you opt out in writing before the event.
Guest content and photo release: By using a booth or experience, guests consent to being photographed or recorded and to the use described here and in our Privacy Policy. Hosts are responsible for informing their guests that photo and video experiences are present at the event.
AI booths: AI-generated images are created automatically and may vary in accuracy or likeness. We do not guarantee specific AI results. Guests should not use AI booths to create content that is unlawful, harmful, or infringes the rights of others.
Content is delivered through our booth software and online galleries. Galleries are generally available for at least 12 months after the event. Please download anything you wish to keep.
6. Text Messaging Program

9. Limitation of Liability
To the fullest extent permitted by law, Moment.Us is not liable for indirect, incidental, special, or consequential damages, including lost profits or lost content resulting from equipment, software, internet, or third-party platform failures.
